Bimi — Terms of Use (EULA)

Welcome to Bimi. These Terms of Use (“Terms”) form a legally binding agreement between you (“you”, “user”) and Bimi (“we”, “us”, “our”). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Overview

Diet-Track is a nutrition tracking application that analyzes meal photos using artificial intelligence to estimate nutritional information. The app also offers optional auto-renewable subscription services.

2. Eligibility

You must be at least 13 years old to use Diet-Track. If you are under 18, you must have permission from a parent or legal guardian.

3. Subscription & Billing

Bimi offers an optional auto-renewable premium subscription.

3.1 Subscription Details

Name: Bimi Premium (Monthly)
Length: 1 month
Price: €9.99 per month (or regional equivalent)
Free Trial: 3-day trial available for eligible users

3.2 Auto-Renewal

Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.

3.3 Billing

Payment will be charged to your Apple ID at the time of purchase.
Renewals are charged to your Apple ID within 24 hours before the renewal date.
You can manage or cancel your subscription in your Apple App Store account settings at any time.
Unused portions of a free trial are forfeited once you purchase a subscription.

4. Use of AI Analysis

Bimi uses third-party AI services to analyze food images.
By using the app, you consent to:

Uploading images to OpenAI’s API for analysis
Dietary estimates that may be approximate and not medically accurate
Understanding that AI results may contain errors or omissions

Bimi is not a medical device. Consult a qualified professional for nutrition or health advice.

5. User Responsibilities

You agree not to:

Upload illegal, harmful, or offensive content
Misuse or reverse-engineer the app
Interfere with the app or its servers
Use the app for commercial, medical, or diagnostic purposes

6. Privacy

Your privacy is important to us.
Our Privacy Policy explains how we collect, use, and protect your data.

7. Intellectual Property

All content, design, branding, images, text, and code in Bimi are owned by Bimi or licensed partners. You receive a limited, non-exclusive, non-transferable license to use the app for personal purposes.

You may not:

Copy or distribute the app’s content
Modify or attempt to extract the app’s source code
Use our trademarks without permission

8. App Changes & Availability

We may update, modify, suspend, or discontinue the app at any time without notice. We are not liable for interruptions or loss of access.

9. Disclaimer of Warranties

Bimi is provided “as is” without warranties of any kind.

We do not guarantee:

The accuracy of nutritional estimates
That the app will be uninterrupted or error-free
That results are medically reliable

You use the app at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Bimi is not liable for:

Any indirect, incidental, or consequential damages
Loss of data or inability to access the app
Health decisions based on app estimates

Our total liability will not exceed the amount you paid for the subscription during the last 12 months.

11. Termination

We may suspend or terminate your access to Bimi if you violate these Terms. You may stop using the app at any time.

12. Third-Party Services

Diet-Track integrates with third-party tools such as OpenAI and Apple systems. Their policies and terms may apply separately.

13. Governing Law

These Terms are governed by the laws of your country of residence, except where local laws require otherwise.
